Sales Policy

Prices All orders must be prepaid in US funds. Sorry, no c.o.d.'s. PagersDirect does not accept international orders.  Prices subject to change without notice.  Pager airtime rates may change at any time.  Prepayment of pager service is not a guarantee that airtime rates will not rise in the future.  If in fact a credit balance is placed on an account for prepayment of airtime and airtime rates are adjusted upwards, account holder will be responsible for any deficiency due on account.  Likewise, if pager service rates are adjusted downwards, the rate in affect at time of renewal will be deducted from the prepaid credit balance (if any) and any remaining credit will be applied to future airtime billing. All prices are posted in US Dollars Colors of models may vary from those shown. Sales Tax All sales for products/services delivered to residence of the state of New Jersey will be charged an additional 7% State Sales Tax. No tax’s will be applied for sales shipped to other states Billing Terms Credit Card orders will be processed in US Dollars. Credit Card Transactions under the name 'DirectPage' on your Credit Card statement. Charges to Credit Cards will be for the total of product shipped.   Backorders: Backorders will be tracked & shipped as product becomes available.   PagersDirect will notify you via email if there are any backorders or unexpected delays. Shipping Please note that that if you intend to make payments by credit card, the name and address should reflect the name and address exactly as they appear on your credit card billing statement. For security reasons, PagersDirect cannot process an order if the shipping address is different than the credit card billing address.  Orders are usually shipped within 3 business days of receiving payment. A minimum shipping charge of $35.00 applies to all orders shipped overnight  by FedEx or UPS.  Tracking numbers will be provided by e-mail.  ADDITIONAL TERMS Typographical Errors and Omissions While PagersDirect tries very hard to ensure the accuracy of the information in our stores, database, and publications, we are not responsible for vendor availability, typographical errors, technical inaccuracies, product pricing errors or omissions. PagersDirect has the right to cancel any orders placed for any product listed at an incorrect price or shown with incorrect information, whether due to typographical error or otherwise and whether or not your order was accepted. Orders placed by credit/debit card or paypal will be authorized in real time to verify validity and funds availability Force Majeure PagersDirect shall not be liable for any delay in or impairment of performance resulting in whole or in part from Acts of God, labor disruptions, shortages, inability to procure product, supplies or raw materials, severe weather conditions, or any other circumstances or cause beyond the control of PagersDirect in the conduct of its business. Cancellation Any cancellation must be approved by PagersDirect, and may be subject to restocking and other charges. Assignment Customer shall not assign any order or any interest therein without the prior written consent of PagersDirect. Any actual or attempted assignment without PagersDirect prior written consent shall entitle PagersDirect to cancel such order upon notice to customer. Modification of Terms PagersDirect's acceptance of any order is subject to customer's assent to all of the terms and conditions set forth in PagersDirect acknowledgment, and customer's assent to these terms and conditions shall be presumed from customer's receipt of PagersDirect acknowledgment, or from customer's acceptance of all or any part of the goods or services ordered. No addition or modification of terms and conditions shall be binding upon PagersDirect unless agreed to by PagersDirect in writing. If a purchase order or other correspondence contains terms or conditions contrary to the terms and conditions contained in PagersDirect acknowledgment, PagersDirect acceptance of any order shall not be construed as assent to any additional terms and conditions, nor will that constitute a waiver by PagersDirect of any of the terms and conditions contained in PagersDirect acknowledgment. Waiver, Choice of Law and Venue The failure of either party to assert a right hereunder or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent nonperformance of any such term or condition by the other party. All transactions shall be governed by the laws of the State of New Jersey, excluding conflict of law rules, and venue shall be in Cumberland County, State of New Jersey. No Third Party Benefit The provisions stated above are for the sole benefit of the parties hereto, confer no rights, benefits or claims upon any person or entity not a party here to.
